4. TERMS AND CONDITIONS OF CONTRACT

1. Subject Matter of the Contract

These terms and conditions govern the contractual relationship for the purchase and reservation of berths or entire boats formalized between the client and BOAT ADVENTURE TENERIFE SLU. The client declares that they have sufficient legal capacity to enter into this contract and have read these terms and conditions in their entirety prior to confirming payment.

2. Prices and Payment Terms

The prices listed for each experience, private charter, or boat rental are expressed in Euros (€) and include applicable taxes (IGIC/VAT as applicable). Bookings are considered confirmed only upon successful processing of the deposit or full payment for the service through our authorized payment gateway.

3. Cancellation, Modification and Refund Policy

Due to the nature of maritime activities, the feasibility of departures is subject to weather conditions and guidelines from Port Authorities and Maritime Captaincy:

  • Cancellation due to weather conditions or force majeure: If the skipper or the company determines that sea conditions are not safe for navigation or respectful whale watching, an alternative date will be offered or a full refund of the amount paid will be issued.
  • Cancellation by the customer:
  • "Cancellations made more than 72 hours in advance will NOT be entitled to a full refund."
  • No refunds will be given in case of failure to appear (No-Show) at the agreed time at Pantalán 5 of Marina del Sur, Las Galletas.

4. Standards of Conduct and Environment (ZEC)

Customers agree to follow all safety instructions given by the captain at all times. As we operate in Special Areas of Conservation (SACs) for the protection of cetaceans in Tenerife, it is strictly forbidden to throw any waste into the sea, feed marine animals, or take any action that alters their natural behavior. The company reserves the right to terminate the excursion immediately, without refund, if any passenger engages in negligent or reckless conduct that endangers safety on board or the ecosystem.
